Use of the Service

SoundWits.com is a service where users can listen to content. By using the Service you agree to these Terms. You are responsible for ensuring that all information you provide is accurate, current, and lawful. You must keep your login credentials secure and are responsible for all activity under your account. You agree not to misuse the Service (including, without limitation, attempting to gain unauthorized access, interfering with operation or security, scraping, or using the Service in violation of applicable law) You are also responsible for your login credentials and you may not share these to gain access for other people.

Limitation of Liability

To the fullest extent permitted by law, SoundWits.com is not liable for (i) inaccurate or outdated information entered by users, (ii) any losses or damages arising from or related to your use of the Service, or (iii) any interruption, suspension, or unavailability of the website or Service.

The service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied (including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement). To the extent liability cannot be excluded, our aggregate liability to you for any and all claims will not exceed the amounts you paid to SoundWits.com for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

Products and Services on SoundWits.com

Subscriptions provide access to audio content for listening while your subscription is active. Fees are charged on a recurring basis until you cancel. You may cancel at any time; cancellations take effect at the end of the current billing period, and partial-period refunds are not provided. If cancelation is done within x days of renewal of subscription period, another subscription period will be mandatory.

Where permitted by law, purchases of digital content accessed by streaming have no right of withdrawal or return. If you are in the EU/EEA and applicable consumer law grants a withdrawal right, you acknowledge that by starting the stream you expressly request immediate performance and agree that your statutory right of withdrawal is lost once streaming begins.

Intellectual Property

All content on the website—including design, text, logos, and images—is owned by SoundWits.com or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. Copying, distributing, public posting, or otherwise using the content without prior written permission from SoundWits.com is not allowed. Feedback you provide may be used by us without restriction or obligation.

Reminders

We may send important service or account reminders (for example, if something is missing in your registration or if there is an issue with your subscription). You can manage non-essential communications in your account or by using opt-out links in our messages. Transactional or service-critical communications may be required and cannot always be opted out of.

Your Data

SoundWits.com does not sell your personal data such as your name or email address. Passwords are stored using industry-standard hashing and cannot be viewed in plain text. We process personal data in accordance with our Privacy Notice, which explains what we collect, why we collect it, how long we keep it, and your rights. You are responsible for keeping your account information accurate and your credentials secure. Your nickname can however be shown on public boards on SoundWits.com.

Changes to These Terms

SoundWits.com may update these Terms when needed. Changes take effect when posted on the website. If we make material changes, we will provide additional notice where feasible (for example, by email or an in-service message). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
